Former court president Andreas Voßkuhle sees the Federal Constitutional Court's previous case law on homosexuality as an example of how courts can also be lacking: in 1957, the court confirmed Paragraph 175, which dates back to 1872 and was tightened by the National Socialists and criminalizes sexual relations between men. The paragraph was not relaxed until 1969 and not completely repealed until 1994. In 2017, the convictions were overturned and those affected were compensated.
